RAMSTORM GAMES (“RamStorm”, “we”, “our” or “us”) highly values the privacy of our users (“users” or “you”).

This privacy policy (“Privacy Policy”, or the “Policy”) sets out how we collect, use and protect your personal data when you access, use and play games, features, content and services via websites, applications and other channels or portals developed and managed by us (hereinafter referred to as the “Services”, explained in more detail below).

Our Services are not designed for players under the age of 13. If you are below the age of 13 (or the age of majority where you live), your parent or legal guardian must consent to providing your personal data to us – please refer to the requirements under the section on “What about Young Users?”. If you do not consent to our collection, use or disclosure of your personal data, please do not use our app or our website.

By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

COLLECTION OF INFORMATION

We collect several different types of information for various purposes to provide and improve our Service to you.

Information We collect about You

When you access or use our Services, in addition to information that you provide directly to us, we also automatically collect certain other information about you.

Information requested by us will be varied depending on the Service you’re using, which may include, but is not limited to:

  • Usage Information: We collect information about your use of our Services, including gaming service ID, levels completed, game scores, time spent using our Services, and other game play information.
  • Log Information: We log information about your use of our Services, including your browser type and language, access times, pages viewed, your IP address and the website you visited before navigating to our Services.
  • Hardware Information: We collect information about the computer or device you use to access our Services, including the hardware model, operating system and version, browser  mobile network information, MAC address, IP address, International Mobile Equipment Identity (“IMEI”) number and other unique device identifiers made available by the operating system of your device.
  • Location Information: We may collect information regarding the geographic location of your device each time you use the Services as provided on iOS or Android platforms, to the extent the setting on your device allows such geographical location information to be collected. You may opt-out of such collection of your geographic location information by changing the settings on your device. Your location information is stored for the period specified in the Services before collection.
  • Information Collected by Cookies and Other Tracking Technologies: We use various technologies to collect information about your experience with the Services, and this may include sending cookies to your computer or mobile device. “Cookies” are small data files stored on your computer hard drive or in device memory that help us to improve our Services and your experience, as well as allow us to see which areas and features of our Services are popular with our users and to count visits.

Information We receive from other sources

We may also obtain information from other third party sources as far as it is necessary to perform our Services, and combine that with information we collect through our Services either directly as provided from you or automatically via your use and/or access. For instance, we may collect game ranking and achievement status from your console or mobile operating system game center application. Additionally, when you complete in-app purchases related to the Services, we may collect information about you from the provider of your device operating system when they process the in-app purchases on our behalf. Please note that we do not receive your payment method information from these operating system providers. In all other cases, we will ask you to authorize us to collect, store, and use your personal information from third parties.

USE OF INFORMATION

We only collect, store and use your information if you have consented to it or, to the extent that it is necessary (1) for the performance of your agreement with us; (2) to comply with our legal obligations; or (3) for the purpose of our legitimate interests, including operating, evaluating and improving our global business. We have carefully balanced our legitimate business interests against your data protection rights. We (or a third party data processor acting upon our instruction) may collect, store and use information about you for the following purposes, for the periods necessary to achieve such purposes:

  • Provide, maintain and improve our Services;
  • Provide and deliver the products and services you request, process transactions and send you related information;
  • Register you for an account on our Services and assist in the management of your account
  • Respond to your comments, questions and requests and provide customer service;
  • Send you technical notices, updates, security alerts and support and administrative messages;
  • Communicate with you about products, services, offers, promotions, rewards, and events offered by RamStorm and our other business partners, and provide news, information and other marketing materials that we think will be of interest to you;
  • Monitor and analyze trends, usage and activities in connection with our Services;
  • Process and deliver contest entries and rewards promoted by RamStorm;
  • Personalize and improve the Services and provide in-Service advertisements, content or features that match user profiles or interests;
  • Link or combine with information we collect from other third parties to help understand your needs and provide you with better service;
  • Detect, investigate and/or prevent fraudulent, unauthorized or illegal activity;
  • For any other purpose required or authorized for us to comply with our legal and regulatory obligations; and

SHARING OF INFORMATION

We do not share, sell, transfer or otherwise exchange your personal information with third parties, unless required for the provision of our Services, otherwise in accordance with this Privacy Policy, or permitted by law, or unless you have given us prior consent to do so. In compliance with the aforementioned, we may share information about you as follows or as otherwise described in this Privacy Policy:

  • With other users if you choose to participate in the interactive areas of our Services, such as community forums (however, the use of personally identifiable data (such as your full name) as a username in our services is strictly prohibited under our Service terms of use);
  • With our employees, affiliates, related companies, vendors, consultants and third party service providers who need access to such information to carry out work on our behalf (including, for example, payment processors, website hosting services, or information storage and processing service providers);
  • In response to legal process or a request for information if disclosure is in accordance with, or as otherwise required by, any applicable law, rule, or regulation (including, for example government or regulatory bodies, law enforcement agencies, or competent courts of law);
  • With law enforcement agencies, government authorities, third party service providers and professional advisors (such as legal counsel) if we have reasonable grounds to believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property and safety of RamStorm, our users or others;

SERVICES PROVIDED BY THIRD PARTIES

We may employ third-party companies and individuals due to the following reasons:

  • To facilitate our Service;
  • To provide the Service on our behalf;
  • To perform Service-related services; or
  • To assist us in analyzing how our Service is used.

We want to inform users of this Service that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.

Ad Networks

We may allow other third parties to provide analytics services on our behalf and to serve advertisements within our Services. These entities may use technologies to automatically collect information about your device and your use of our Services, including IP address, device ID, time spent on pages within our Services, and links clicked within our Services.  This information may be used by us and others to, among other things, maintain, improve, and analyze the functioning of our Services and deliver contextual or targeted advertising that may be of interest to you. The use of your information by these third parties is covered by their respective privacy policies, and we do not control and are not responsible for the privacy practices of such third parties.

Mobile Analytics

We and our marketing and outsourcing partners, affiliates, or analytics service providers use technologies such as cookies, beacons, scripts, and tags to identify a user's device and to "remember" things about your visit, such as your preferences or a user name and password. Information contained in a cookie may be linked to your personal information, for purposes such as improving the quality of our Services, tailoring recommendations to your interests, and making the Service easier to use. You can disable cookies at any time, although you may not be able to access or use features of the Service.

Social Media Features and Game Center Features

The Services may offer social media features or other tools, which let you share actions or link the Services with social media. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the social media platform.  For more information about the purpose and scope of data collection and processing in connection with social sharing features, please visit the privacy policies of the social media platforms. We are not responsible for the privacy practices of third-party apps, websites or services that are linked from our Services.

Our Services may enable certain game center features (“Game Center Features”) and may include Social Features as well. The Game Center Features and the Social Features are operated or allow for social integration with certain third-party social networks (“Social Networks”), e.g., Facebook Connect or other third-party platforms (“Social Platforms”).

These Social Networks and Social Platforms are created and maintained by third parties (“Social Partners”) who are not affiliated with and/or controlled by Tapps.

If you enable integration with such Social Networks and Social Platforms, your use of the Game Center Features and/or the Social Features is subject to the applicable Social Partners’ terms of use and privacy policies (collectively, “Social Terms”), for example:

IN-APP PURCHASES

We may provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American

Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Please note that purchases of Stores’ credits or currencies may also be subject to their own policies.

PUSH NOTIFICATIONS

RamStorm may send push notifications or alerts to your device. You can deactivate these messages at any time by changing the notification settings on your device. RamStorm will send push notifications or alerts with promotional content only after your prior opt-in to receiving such messages on your device.

SECURITY OF YOUR INFORMATION

We take reasonable technical and organizational measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. However, no transmission over the internet can ever be guaranteed secure so we cannot guarantee the security of any personal information that you transfer over the internet to us.

DATA RETENTION

We will only retain your personal data for as long as reasonably necessary to fulfill the purposes set out in this Policy. We will either delete or anonymize your personal data when it is no longer required to satisfy the purposes set out in this Policy.

INTERNATIONAL TRANSFER OF DATA

We may choose to store your personal data on a local server or a server located in a foreign country depending upon the IT configurations of our websites and mobile applications, which may be adjusted from time to time.

Where the transfer of your personal data to a server located in a foreign country satisfies the definition of international transfer or cross-border transfer of personal data under the applicable law, we will determine the legal basis for the transfer and take appropriate security measures to ensure a level of protection as required under the applicable law.

This Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

POLICY CONCERNING CHILDREN

Our Services are designed and provided to users of various age groups. We will not collect personal data from any users who are under the age of 13. If parents or legal guardians suspect that their children, under the age of 13, have provided us with personal data inadvertently, they may request such personal data be removed by contacting us at [contact@ramstorm.games].

Users who are between 13 and 18 years old (or the relevant age defined as a minor in the respective jurisdiction) should seek the consent of their parents or legal guardians before using our Services.

CalOPPA – CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83 permits our Users who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. California residents have the right to receive:

a) information identifying any third-party company(ies) to whom Tapps may have disclosed (within the previous calendar year) Personal Information pertaining to You and your family for that company’s direct marketing purposes; and

b) a description of the categories of Personal Information disclosed.

If You are a California resident and wish to obtain such information, submit a request here at data-controller@tappsgames.com  with "Request for California Privacy Information" as the subject line and in the body of your message. Please be aware that not all information sharing is covered by requirements and only information on covered sharing will be included in our response. Please also note that under California law, businesses are only required to respond to a customer request once during any calendar year.

GDPR

Users who are resident in the European Union have the following rights:

a) to access and receive a copy of the Personal Information Tapps holds about you, free of charge, with a time limit of one month to respond,

b) to rectify any Personal Information held about you that is inaccurate or incomplete and

c) to request the erasure of personal data, in some circumstances, held about you without undue delay when the use or other processing of such personal data is no longer necessary for the purposes for which is was collected or otherwise processed, and in certain other circumstances,

d) to restrict the processing of your personal data by us, in some circumstances,

e) to request receipt or transmission to another organization, in a machine-readable form, of the Personal Information data that the we hold,

f) to object to the processing of your personal data for marketing purposes and/or on grounds related to your particular situation.

From time to time we may ask you to confirm the accuracy of your Personal Information. You may have the right.

In the event that you wish to make a complaint about how we process your Personal Information, please contact us in the first instance using the details below and we will endeavor to deal with your request as soon as possible, as it is our intention that Personal Information will be managed responsibly by us in accordance with the purposes set out in this Privacy Policy. This is without prejudice to your right to file a complaint with the competent data protection authority in the EU member state in which you reside, in the event you still have unresolved concerns about the processing of your Personal Information.

CHANGES TO OUR PRIVACY POLICY

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the “Effective Date” at the top of this Privacy Policy.
